(b) If any term or provision of these Terms and Conditions is found to be invalid, illegal or unenforceable, such invalidity, illegality or unenforceability shall not affect any other term or provision of these Terms and Conditions or the remaining part of such term or provision, or invalidate or render unenforceable such term or provision or part thereof in any other jurisdiction. Upon determination that any term or provision or part thereof is invalid, illegal or unenforceable, such valid legal, enforceable term or provision as corresponds as closely as possible to the commercial intention of the parties shall apply.
(c) The failure of either Assurant or the User to insist upon strict performance of any provision of, or to exercise any right available under, these Terms and Conditions shall not be construed as a waiver of any provision or right.
